CYPRESS COVE RULES AND REGULATIONS

The pleasantness of condominium living is greatly enhanced by a congenial atmosphere in which all residents have proper regard for the comfort of others. For this reason, these rules and regulations have been adopted by the Cypress Cove Condominium Owners’ Association, Inc. (the “Association”). To assure residents and their guests that the condominium property will be properly used for the benefit of all these persons. All residents are requested to cooperate with the management in seeing that the rules and regulations are observed. These rules and regulations are set in place for all owners to have one common goal, and that is the value of their unit(s), and uniformity maintains that.

  1. ADDRESS. Residents should designate their address as follows:

  • CONDOMINIUMS LIVING. Condominium living requires that each resident regulate the occupancy and use of their unit so as not to unreasonably or unnecessarily disturb any other resident in the occupancy and use of their unit. All residents are requested to use their units accordingly.
  • RESIDENTS AND GUESTS. The facilities of Cypress Cove Condominiums, are only for the use and enjoyment of residents. Visitors will be permitted to use the facilities only as a guest of a resident and that resident will be responsible for the acts of their guest(s).
  • CHILDREN AND TEENAGERS ACTIVITIES. Children and teenagers are welcome at Cypress Cove Condominiums and there is no desire to restrict their normal activities. Nevertheless, they are required to observe the same restrictions that apply to adults. This includes the playful use of equipment, the use of any common elements in the building for play areas, or any other conduct that will interfere with the quiet and comfort of residents. Adult residents with whom children and teenagers are living with, will be held responsible for the observance of these rules and regulations. All children and teenagers will be under the direct control and supervision of a responsible adult. Children and teenagers under the age of 18 may not use the pool or beachfront areas unaccompanied by an adult.
  • SECURITY. No security will be provided by the Association. It is the responsibility of each unit owner to provide their security. This requires that all unit doors be locked at all times; solicitors are not allowed to enter any unit without an appointment, and all suspicious appearing persons should be reported to the Biloxi Police Department. Any incidents should be reported to one of the association board members.
  • USE OF UNITS.
  • Air Conditioning/Hot Water Tanks. When the heating or air conditioning unit is operating, windows and doors are to be kept closed as much as possible. Not only is this an economically sound practice, but keeping the doors and windows closed will reduce the admitting of moisture in the warm or cold air which results in dampness and possible mildew in your unit, which could spread to other units. The inside and outside air conditioner systems are the responsibility of the condominium unit owner. You should have these checked and serviced frequently. If there is any malfunction to the a/c unit or hot water tank system that causes damage to the building of your condo unit other condominium units, you will be held responsible for the repair(s) of that damage. This is important to the second-floor condominium units where some air conditioning systems and hot water tanks are in the attic. If any water leaks or malfunctions from either of these devices and causes damage to your condominium unit or others, you will be held responsible for any repairs. This includes ceilings, drywall and floors.
  • Balconies/Decorations/Signs. No unit owner shall decorate any part of their unit balcony or railings, or that of the balconies and railings of the building without permission of the Cypress Cove Board of Directors. Any painting of the beach-facing or pool balconies will remain white and the exterior of the walls must conform to the color of the building. Any painting of the exterior building, railings, walls, or balconies must be approved by the Cypress Cove Board of Directors. Beachfront unit owners are responsible for their own balcony fan and light. The ceiling fan must be white, the light on the brick wall must be black, and closely resembling original light if replaced. If the balcony ceiling fan causes overhead ceiling damage due to high winds or any other cause, the owner is responsible for the repair. Note: There are outdoor white ceiling fans that come with removable blades. When high winds are approaching the removal of these blades will limit your damage to the mounting area. Display of plants or other objects upon balconies, railings, overhead structures, walls, or unit exterior window sills or ledges is prohibited. Under no circumstances will live plant containers be allowed on the balconies that will permit water and/or plant fertilizers to soak through to the building floors and/or lower walls and railings. This is detrimental to the building structure, which may be very costly to repair. The owner responsible will pay for all costs incurred in the repairing of such structure if they are found at fault. All interior blinds or shutters displayed in the unit windows must be solid white, with no display of pictures or writings. All doors will display the unit number in black, centered, and approximately twelve (12) inches from the top of the door, as unity is of importance for every owner. No signs may be displayed in any nature or manner by unit owners or their tenants on their doors, windows, balconies or their unit structure, this includes rental and for sale signs. Any exception must be approved by the Board of Directors in writing.

Note: There is a bulletin board by the post office boxes where you can publicize your unit for sale and also one in the laundry room. Relator agencies, and online sites is recommended.

  • Fire Hazards. No article shall be stored nor made of any part of the condominium property that will constitute a fire hazard.
  • Hanging of Objects. The hanging of bathing suits, clothes, rugs, towels, signs, banners, or other items upon balconies, railings, or windows is prohibited except for the proper display of the United States flag with Cypress Cove Board of Directors’ approval of the size of the flag.
  • Installations. Awnings, blinds, shades, and screens of any type may not be used unless approved in writing by the Cypress Cove Board of Directors.  White hurricane shutters have been approved for use on the beachfront units by the City of Biloxi and the Historical Society, but they must meet certain requirements. Therefore, they must be approved by the Cypress Cove Board of Directors to verify that they meet these requirements before installation. Failure to do so could be very costly to the unit owner who does not abide by these requirements of the Association Rules and Regulations, the City of Biloxi, and the Historical Society.
  • Maintenance and Repair. Unit owners are reminded that maintenance and repair of the condominium building is the responsibility of the Association except for the interior of the unit. As authorized by the condominium documents, the Board of Directors has the responsibility of the unit owners except in case of damage for which insurance proceeds are available. No work of any kind is to be done upon the part of the building maintained by the Association without first obtaining the approval required by the condominium documents. Occupants of units under sublease are reminded that the responsibility of maintenance and repair between the lessor and lessee is established by their subleases. Regardless of the responsibility for maintenance and repair, it is recommended that the need for such work be reported immediately to one of the Board of Directors who can be of assistance in obtaining prompt service. Service provided by the Association or Board of Directors for which the unit owner is liable will be charged to the unit owner. The unit owner is responsible for any wiring, electrical, and plumbing within their unit. If there is any maintenance or repair inside or outside to any of the condominium(s) that needs to performed by the HOA, the unit(s) owner will be notified and they have 3-7 days to comply with the notice, allowing the work to be performed. If access is not given by the owner on the seventh (7th) day, a twenty-five dollar ($25) a day fine will be imposed till access is granted. To any of the common or exclusive common element areas, access will be granted by the board to perform the upkeep of maintenance or repairs of these common areas. If access is needed to any one or all of the beachfront unit exclusive common areas balconies, that owner(s) will be notified that the work will begin on their balcony area within 3 days with a date and time. If the owner does not allow condominium walk-through access to the exclusive common area, then access will be gained to the unit’s balcony area, by a maintenance worker using a ladder.
  • Noise. To ensure the comfort of all residents, the playing of phonographs, radios, television sets, cell phones, and musical instruments must not exceed a reasonable volume at any time. This applies to all public and common areas as well as inside units. Between the hours of 10:00 PM. and 10:00 A.M., the volume shall be kept at a level that cannot be heard outside the unit in which the noise is located. All residents and guests shall refrain from any activity that would disturb other residents in the common areas and their units, especially during this time frame.
  • Pets. Two Domestic pets total, (dogs or cats only) may be kept by the unit owner. Each dog or cat is not to exceed twenty-six (26) pounds. Grandfather Clause: Any owner that already has a pet that weighs more than this requirement will be grandfathered in and exempt from this weight exemption until the unit owner no longer owns this animal or the animal is transferred to another owner. Service or emotional support dogs that exceed this weight requirement may be allowed under the Americans with Disabilities Act (ADA), but certification or documentation will be required for clarification. No animals shall be kept in an owner’s unit for commercial purposes. If an owner leases its unit, the tenant of the unit owner may be allowed to keep domestic dogs and cats (but no more than a total of two (2) during the tenancy if allowed in writing by the unit owner. Each tenant will be subjected to the same rules and regulations as the unit owner. No animal will be allowed to create or cause a disturbance of any kind, and if said animal causes or creates a disturbance of any kind, that animal shall be permanently removed from the Association property within three (3) days of the owner receiving written notice from the Board of Directors. The owner or lessee of any pet shall be liable for all damages caused by their pet to any part of the Condominium Property. The owner or lessee shall be responsible for removing any droppings of their pet.

Sec. 4-1-2. Animals shall at all times be leashed and shall not be permitted to run at large.

Sec. 4-1-24. – Removal of dog waste.

It shall be the duty of each person who owns, possesses, or controls a dog to immediately remove and dispose of any feces left by that dog on any sidewalk, street, other public area, or any private property neither owned nor occupied by said person.

  • Use Restrictions. Residents are reminded of the restrictions upon use of the condominium property that are written in the condominium documents. The restrictions require, among other things, that a unit may be used only as a residence either permanent or transient. No nuisances shall be allowed nor any practice followed that is the source of annoyance to other residents or in violation of city, county, state, or federal laws or regulations.
  • Waste Disposal. All waste is to be disposed of in the trash dumpster. No garbage or any other such materials will be left outside of a condominium unit for disposal. All cigars and cigarettes shall be extinguished and disposed of properly, they are not to be thrown on the ground or from windows and balconies.
  • Doors/Windows/Window Screens. This area is subject to sudden rainstorms without warning. To avoid water damage to a unit as well as other parts of the building, occupants are reminded to keep doors and windows closed as a precaution. Failure to close doors and windows that result in damage to the condominium structure will render the unit owner liable for the resulting damage. Doors, windows, and window screen enclosures are the responsibility of the condominium unit owner and they must be white and maintain unity with all other condominium units. Any replacement must be approved by the HOA board of directors and must conform to the Historical Society Regulations. Failure to get approval from the board of directors and not conforming to the Historical Society standards could be very costly to the unit owner.
  • USE OF COMMON ELEMENTS AND OTHER FACILITIES
  • Exterior of Building. No one may mount any object upon the exterior or roof of the condominium building without the approval of the Board of Directors in writing. 
  • Balconies, Fire Escapes, Halls, Stairways, and Walkways. These areas are part of the common elements and will be maintained by the Association or as the Board of Directors instructs. These areas are for ingress and egress to and from units and shall not be obscured. These areas must remain free from any obstruction which includes bicycles, garbage cans, baby carriages, or anything that obstructs the passage of individuals. This is a fire code insurance requirement and must be complied with. This requirement is for the safety and protection of residents in case of fire or other emergency, such as an ambulance team bringing in a gurney, and will be strictly enforced.  The beachfront unit balconies are considered an “exclusive common element” (for the owner’s use). That owner should perform upkeep and regular maintenance of their balcony area. Beachfront owners must not make any major repairs or replace any part of the balcony area without first approval from the HOA board of directors. This includes the replacement or installation of tile floors, lights, and white fans which are the responsibility of the unit owner. Any replacement will need approval from the HOA board of directors.
  • The owner’s property is from the drywall inward. The balconies in the common areas are Limited Common areas and HOA responsibility.
  • Pool area is for private use only. No running, and No jumping is permitted, or anything that would interfere with the quite enjoyment of the pool, such as loud music. Smoking is not permitted in the gated pool area. No food or drinks are permitted in the pool. No glass or breakable containers are allowed. No pets are allowed in the fenced in area of the pool or in the pool. No lifeguard on duty, all persons using the pool, do so at their own risk. All persons using the pool and the pool area must clean up after themselves. If there is garbage and debris left over after your use of the pool or the pool area, you will be held responsible for the cleanup fee. This fee will be determined by the clean-up crew hired if the debris is excessive, or a $50 (fifty dollar) fee if cleaned up by the HOA members, and it is not excessive.
  • LESSEES.  Unit owners who lease their units are required to give the HOA board of directors a copy of the lease, which designates the length of time that the lessee is residing, their automobile description, and auto license plate number. Cypress Cove is in Ward #1 and in a historical district that does not allow rentals for less than 30 days. Failure to lease at a timeframe of less than 30 days is a $500-a-day fine and is enforced by the city code inspectors, which inspect our property frequently. Failure to provide the automobile description and license plate number could also involve having the lessee’s vehicle towed and impounded at the lessee’s expense.
  • PARKING AREAS. Parking areas are for use by unit owners, lessees, and their guests.

These general and reserved spaces are provided for Personal vehicles which are used by them for transportation on a daily basis. There is no charge to park in a general space. No recreation vehicles, buses, motor homes, boats, or commercial trucks are permitted to be parked on Cypress Cove Condominium property. Temporary parking of these types of vehicles may be allowed by approval of the Board of Directors and a fee of $100 a month will be charged and due on the first day of parking and every month thereafter. This fee will be non-refundable. Grandfather Clause: If you have already been approved by the Board of Directors to park any of these types of vehicles listed, you may continue to do so, till the time you no longer own any of these vehicles, it is transferred to another owner, or it is removed from the property. Reserved parking spaces for automobiles may be purchased if available, at a rate of $100 a year. One (1) space for one bedroom, and two (2) spaces for two and three-bedroom units. If a unit is purchased, the new owner will have the first claim to the previous owner’s reserved parking space. If the new owner does not purchase the reserved parking space from the previous owner it will become available to any of the Cypress Cove Condominium owners that are on the list sheet. Any owner may put in a request for a reserved parking space or reserved handicap parking space by adding their name to the list sheet held by the Directors of Cypress Cove. If the previous unit owner has a reserved handicap parking space and the new owner does not have a permanent handicap placard or a designated license plate, that reserved parking space will be go to the first available Cypress Cove Condominium owner from the top of the list, who has a valid handicap placard or license plate, and has requested a reserved handicap parking space. The previous owner will lose any monies left over from a reserved parking space and the new owner will pay on the day they reserve a parking space. Prorated to February.

  1. Association Access. To facilitate its right of access to all units and according to its statutory right the Association Board of Directors shall retain a key or lock code for each unit. This is necessary for insurance purposes which require fire and other inspections. The unit owner shall also provide a key or lock code whenever locks are added or codes are changed. It is the responsibility of the unit owner to provide this key or code to the Cypress Cove Association Board of Directors. All keys for common area storages, closets, or rooms are held by the Cypress Cove Association Board of Directors and may be available upon request.
  2.  Risk Management. No owner will permit anything to be done or kept in any unit or common elements that would result in an increase or cancelation of insurance on the building or the contents of the building, or that would violate any law or building code.
  3.  Application of Regulations. These rules and regulations will apply equally to owners, their families, guests, domestic help, and lessees and each unit owner will be responsible for the conduct of their families, guests, domestic help, and lessee. These rules and regulations must be maintained by the owners, the owner’s family, lessees and guests. If at any time the board finds it necessary to impose fines for the violation of the Cypress Cove Rules and Regulations, it will be on a case by case basis and a maximum daily fine of up to twenty-five dollars a day may imposed.
  4.  Right to Amend. The Cypress Cove Board of Directors reserves the right to change, amend, delete, and/or waive any of the rules set forth herein by way of vote, by the Home Owners Association.
  5.  Reference to Other Documents. These rules and regulations do not purport to constitute all of the restrictions affecting Cypress Cove Condominium and common property. Reference should be made to the Condominium documents, in the event of a conflict between these Rules and Regulations and the Declaration of Condominiums or the By-Laws of the Association, the Declaration of Condominiums and the By-Laws of the Association shall control.
